The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

The allegation is that the petitioner entered into an agreement to sell land to the informant. However, subsequently it revealed that the land was not of the petitioner. Submission is that the consideration money has already been refunded to the informant and the parties have entered into a compromise vide Annexure-2.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt

Patna High Court Cr.Misc. No.53026 of 2016 (2) dt.21-12-2016 2/2 of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/Successor Court in connection with Banka Police Station Case No. 773 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
