The petitioner seeks anticipatory bail in Sangrampur P.S. Case No.153 of 2016 instituted for the offences under Sections 147, 148, 149, 323, 324, 373, 447, 307 and 504 of the Indian Penal Code.

Allegation has been made that while the victim who is full brother was doing his work in his field petitioner and entire family members had gone there and started assaulting the the victim.

Learned counsel for the petitioner submits that basically it is a land dispute in between the petitioner and informant.

Patna High Court Cr.Misc. No.40781 of 2017 (2) dt.22-09-2017 Medical report reflects that there was lacerated and simple injury.

In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of four weeks from today, the court below will pass an order taking into consideration that there is a land dispute between two brothers without being prejudiced by the order passed by this Court.
