JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Though, the present writ petition was filed initially for directing the respondent- authorities to open the medical shop of the petitioner which has been sealed, however during the pendency of this writ petition, the Assistant Drug Controller, Nalanda has passed an order dated 18.08.2021, whereby and whereunder the drug license of the petitioner bearing License

Patna High Court CWJC No.11889 of 2021(2) dt.22-09-2021 2/2 no. BR-NAL-135763 and BR-NAL-135764 have been cancelled.

The learned counsel for the petitioner, at the outset, seeks liberty on behalf of the petitioner to file appropriate appeal before the State Government under Section 66(2) of the Drugs and Cosmetic Act, 1945.

Accordingly, the present writ petition stands disposed of as not pressed, however with liberty to the petitioner to file appropriate appeal before the State Government and in case, such an appeal is filed within a period of four weeks from today, the same shall be considered on merits, without being impeded by the issue of limitation and appropriate orders shall be passed, within a period of six weeks, thereafter.
