JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Mohiuddinnagar P.S. Case No. 209 of 2016, registered under Sections 304(B) and 201/34 of the Indian Penal Code. The accusation is of killing of Rupa Devi, sister of informant, by her husband and in-laws due to non-fulfillment of demand of dowry and to dispose of the dead body. Learned counsel for the petitioners submits that petitioners are father-in-law, mother-in-law, sister-in-law (Gotni) and brother-in-law of the deceased, sister of ifnormant and they

Patna High Court Cr.Misc. No.15054 of 2017 (6) dt.31-07-2017 have falsely been implicated in this case with general and omnibus allegation. In fact, after the death of Rupa Devi, sister of the informant, Shrawan Kumar, father of the informant, performed the marriage of his another daughter, Parwati Kumari, with Manish Kumar, husband of deceased, Rupa Devi and both are residing together.

Considering the aforesaid submissions, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Samastipur in connection with Mohiuddinnagar P.S. Case No. 209 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
