19-02-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in relation to Majhaulia P.S. Case No. 311 of 2017 registered under Sections 379/420 of the Indian Penal Code. Learned counsel for the petitioners submits that only on the alleged disclosure of the accused Rajdeo Mahto these petitioners have been implicated in the present case. It is also submitted that they have no criminal history and are ready to abide by the terms and conditions as also would cooperate in course of trial.
Learned counsel for the State is present.
Considering the facts and circumstances that
Patna High Court Cr.Misc. No.6829 of 2018 (2) dt.19-02-2018 the petitioners have been named and they have not been apprehended on the spot and nothing has been recovered from their possession and they have no criminal antecedent, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioners be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Majhaulia P.S. Case No. 311 of 2017, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure further condition that the petitioners shall cooperate in course of trial and two consecutive defaults in putting appearance shall lead to cancellation of bail bond of the petitioners.
