2. The petitioner is apprehending arrest in connection with Chhatapur P.S. Case No. 141 of 2021 lodged on 19.05.2021, for the offence punishable under Sections 341, 323, 324, 325, 307, 379, 504, 506 & 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioner against whom there is allegation that they have assaulted the informant's husband with iron rod causing injury on his head.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the only allegation against the petitioner is that he was armed with lathi and dagger and he did not assaulted the informant's husband. Counsel submits that there is no allegation of act or overt act against the petitioner, rather, there is general

Counsel submits that after completion of investigation, police has submitted final form against the petitioner and found no case against him. Counsel submits that the Judicial Magistrate 1st Class has taken cognizance against the petitioner in this case. Counsel further submits that the petitioner has no criminal antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Supaul, in connection with Chhatapur P.S. Case No. 141 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
