The petitioner apprehends his arrest in Lodipur P.S. case No.85 of 2016 under Section 365, 347, 348 of the Indian Penal Code.
The informant alleged that on 21.07.2016 Basuki Mandal came and took her son, Sushil Mandal, but Sushil Mandal did not return.
The learned counsel for the petitioner submits that petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. One Raj Raushan disclosed the name of petitioner in his confessional statement. Save and except confessional statement of co-accused, no tangible material is collected against the petitioner.

No.45782 of 2016 (2) dt.25-11-2016 2/2 Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Bhagalpur in Lodipur P.S.
