The petitioner apprehends his arrest in connection with Madanpur P.S. Case No. 15 of 2017 registered under Sections 414 and 420 of the Indian Penal Code.
The accusation is that, on receiving secret information about unloading the illegal coal from a truck at the Usha Brick kiln, the informant being police official reached there and found that two ton coal was unloaded from the Truck bearing registration no. Jh-02T 8083. On quarry, Shyamsundar Yadav, driver of the truck, produced the paper of the truck load coal, from which, it appears that the coal was loaded at Barwadda Dhanbad for unloading at at J.J. Traders and Goods Carrier, Muzaffar Nagar

Learned counsel for the petitioner submits that petitioner has no concerned with the truck and coal and the same was recovered from the road side not at the brick kiln of the petitioner. Moreover, the petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 15 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
