JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner prays for anticipatory bail in connection with complaint case no. 1000 of 2012 registered for the offences punishable under Sections 379 and other sections of the Indian Penal Code.

Patna High Court Cr.Misc. No.52086 of 2016 (2) dt.21-12-2016 2/2 There is general and omnibus allegation against the petitioners except petitioner no.1 who is alleged to be order- giver. It has been submitted on behalf of petitioner that prior to the filing of this case, a case has been lodged by the petitioner against the informant and others and F.I.R. of that case has been annexed as Annexure-3 of the petition. Further, there was title suit going on between the parties of the case. Heard learned A.P.P. also.

Having heard both sides and considering the fact that there is no specific allegation against any of the petitioner and that the land dispute is going on between the parties, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Madhepura in connection with complaint case no. 1000 of 2012 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
