JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-02-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Meerganj PS case no. 95 of 2016 registered for the offences punishable under Sections 302, 201/34 of Indian Penal Code.

A perusal of the First Information Report (in short the "FIR") would show that the FIR was lodged against unknown by the chowkidar. It is alleged that the chowkidar found a dead body of an unknown person lying on the Eastern side of SH77 near Kishantoli Chowk.

The learned counsel for the petitioner submits that in course of investigation, the name of the petitioner transpired on the basis of statement of the father of the deceased. He had made this general allegation against the petitioner as well as the

Patna High Court Cr.Misc. No.10234 of 2018 (2) dt.22-02-2018 2/2 co-accused Md. Israil. It is further submitted that the co-accused persons namely Md. Israil and Barun Pandit @ Lambu Pandit have already been granted regular bail by a co-ordinate Bench of this Court vide order dated 12.07.2017 passed in Cr.Misc. no. 31236 of 2017. It is further submitted that one other co-accused has also been granted bail by this Court by an order dated 19.08.2017 passed in Cr.Misc. no. 38473 of 2017. Having regards to the facts and circumstances of the case, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail.

Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Meerganj PS case no. 95 of 2016 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
