Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Liquor was recovered from the bamboo orchard. Submission is that the petitioner has no concern with the liquor or the said orchard.

Considering the fact that the petitioner has got four

Patna High Court CR. MISC. No.27725 of 2020(2) dt.24-11-2020 2/2 identical criminal antecedents, in my view, this is not a fit case for grant of anticipatory bail. Hence prayer for anticipatory bail of the petitioner is refused in connection with Bochahan P.S. Case No. 344 of 2019.

However, in the event of surrender of the petitioner, prayer for regular bail shall be considered on its own merit without being prejudiced by this order.
