JUSTICE SATYAVRAT VERMA ORAL ORDER 11-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Dinara P.S. Case No. 335 of 2020 dated 03.12.2020 instituted for the offences under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 11.01.2021 and charge-sheet has been submitted in the case.

Learned counsel for the petitioner submits that allegation as alleged in the F.I.R. is that while the informant was returning to his home after closing his shop, six accused persons accosted him near rice mill of Rama Muni and snatched Rs. 19,000/- and his mobile.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.37542 of 2021(3) dt.11-01-2022 2/2 F.I.R. was against unknown and the name of the petitioner transpired in the confessional statement of co-accused Rahul Kumar. It is further submitted that confession made before the police is not admissible in evidence.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 11.01.2021, charge-sheet has been submitted in the case and name of the petitioner transpired in confessional statement of co-accused, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rohtas in connection with Dinara P.S. Case No. 335 of 2020.
