The petitioner apprehends his arrest in connection with Konch P.S. Case No. 99 of 2002, registered under Section 436/34 of the Indian Penal Code.
The accusation is that, at about 9 P.M., on 21.11.2002, when the informant and his family members was going to sleep in his house then saw that fire broke out in the Fush room situated in front of his house. At that time, Amod Singh, Raja Singh (petitioner), Munna Singh and Arvind Singh wee seen running towards north direction. When the informant rushed there then Amod Singh fired in air.
Learned counsel for the petitioner submits that, in fact,
Patna High Court Cr.Misc. No.39834 of 2017 (5) dt.13-12-2017 petitioner is the co-villager of the informant and he has falsely been implicated in this case mere on suspicion. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Gaya, in connection with Konch P.S. Case No. 99 of 2002, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
