Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner Nos. 1 & 3, namely, Munnilal Rai and Chhote Lal Rai.

Permission is accorded.

Accordingly, the petition with regard to petitioner Nos. 1 and 3 is dismissed as withdrawn.

Patna High Court CR. MISC. No.28477 of 2022(4) dt.07-12-2022 2/3 The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 324, 307, 379, 504, 506/34 of the Indian Penal Code.

It is a case of assaulting due to which informant and his son sustained head injuries. It is also alleged that one of the co-accused persons snatched one golden chain from the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. There is case and counter case between the parties. It appears from the perusal of impugned order that injury report is not brought on record to support the prosecution version. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, except petitioners Nos. 1 & 3, namely, Munnilal Rai and Chhote Lal Rai, in the event

No.28477 of 2022(4) dt.07-12-2022 3/3 of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Danapur in connection with Maner P.S. Case No. 20 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
