Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Mithanpura P.S. Case No. 387 of 2022 registered for the offence under Sections 25(1-B)a, 26, 35 of the Arms Act and Sections 8/20(b)(ii)(B), 8(c) and 21(c) of the N.D.P.S. Act. The allegation against the petitioner is that during vehicle checking, one loaded pistol with five live cartridges and 230 grams of Smack was recovered from the possession of the petitioner.

Learned APP for the State opposed the prayer of bail

Patna High Court CR. MISC. No.28289 of 2023(2) dt.24-05-2023 2/2 by contending that the petitioner is a person involved in dealing of intoxicated articles and he has criminal antecedent also. In view of the fact as mentioned above and the amount of recovery, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.
