JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends her arrest in connection with Kesariya P.S. Case No. 39 of 2017, registered for the offences punishable under Sections 379, 366A/34 of the Indian Penal Code.

The petitioner is mother of co-accused Ajay Sah. Allegation against Ajay Sah is that he enticed to the married daughter-in-law of the informant to go with him and fled away along with her with cash and ornaments.

Submission is of false implication and that the petitioner has got no role in the incident but as she is the mother of Ajay Sah she has been made accused in this case only with a view

Patna High Court Cr.Misc. No.44377 of 2017 (2) dt.21-09-2017 2/2 to give colour to the case. Jaga Sah the husband of the petitioner has been allowed regular bail vide Cr. Misc. No. 30279 of 2017 by another co-ordinate Bench of this Court and against the petitioner also there is no substantial allegation and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. fairly submits that Jaga Sah has been allowed regular bail.

In the facts and circumstances as stated above, considering that there is no substantial allegation against the petitioner, the petitioner in the event of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihar, East Champaran, in connection with Kesariay P.S. Case No. 39 of 2017, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
