Shahi, learned senior counsel, assisted by Sri Vikash Kumar, learned counsel for the petitioner and Sri Sanjeev Kumar, learned counsel for the informant. This is 2nd attempt for grant of bail on behalf of the petitioner in connection with Srinagar (Pujaha) P.S. Case No. 85 of 2017, registered for the offence under Section 302/34 of the Indian Penal Code, 1860 and Section 27 of the Arms Act, 1959. Earlier, on 20.08.2018 prayer for bail of the petitioner was rejected vide Cr. Misc. No. 49191 of 2008. Learned senior counsel tried to persuade the court to extend the privilege of bail to the petitioner in view of the fact that petitioner on the last date of rejection of the prayer for bail was aged about 75 years. He further submits that there is allegation of no overt act against

Sri Shahi has also referred to medical report of the petitioner to show that petitioner is ailing with old age. Earlier, a report was called for from the court below regarding stage of the case, which has been received and kept at flag- A. The report dated 21.05.2019 makes it clear that the case is fixed for evidence. Besides this, once on merit prayer for bail was rejected and also age of petitioner was considered, there is no reason to again examine the same.
The prayer for grant of bail again stands dismissed. (Rakesh Kumar, J) praful/- U T
