JUSTICE BIRENDRA KUMAR ORAL ORDER 20-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147,148,149,323,307,337,353,427,435,436 of the Indian Penal Code and Section 27 of the Arms Act.
According to FIR, one Amarjeet Singh @ Amar Singh allegedly caused firearm injury to Bimlesh Kumar @ Bablu. The infuriated villagers started assault on Amarjeet Singh @ Amar Singh, as a result whereof, Amarjeet Singh @ Amar Singh died. Thereafter, supporters of Amarjeet Singh @ Amar Singh blocked the road traffic. When the police came, they pelted stone on the police party and damaged the police
Patna High Court CR. MISC. No.27798 of 2020(3) dt.20-01-2021 2/3 jeep as well as obstructed in discharge of official function of the police. In the mob, 19 persons including the petitioner was identified.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. No overt-act is alleged against the petitioner.
Since the petitioner is resident of the same village, he might have been identified at the spot when the petitioner could have been passing by from there.
Considering no direct material against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Chandradeep P.S.Case No.82 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case and also the petitioner shall not leave the country without permission of the learned Trial Court , failing which the court below shall be
