Earlier prayer for bail of this petitioner was rejected vide order dated 02.09.2019 passed in Cr. Misc. No. 41520 of 2019.

The petitioner has been in custody since 16.07.2018 in connection with Baliya (Ballia) P.S. Case No. 270/2013 registered for the offences punishable under Sections 147/148/ 149/ 326 /307 /302/504 of the Indian Penal Code and Section 27 of the Arms Act.

On the last occasion, the report was called for from the court below. On perusal of the same, it appears that out of six witnesses, none has been examined though charges have already been framed on 10.01.2020.

Learned counsel for the informant undertakes to

Patna High Court CR. MISC. No.27651 of 2020(3) dt.07-12-2020 2/2 produce all the witnesses within a period of two months. Considering the stage of trial, I am not inclined to grant bail to this petitioner. It is, accordingly, rejected. However, since petitioner is in custody since 16.07.2018, the trial court is directed to conclude the trial as early as possible.
