====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 13-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Teghra P.S. Case No.145 of 2017 registered under Sections 341, 323, 379, 427, 406 and 504/34 of the Indian Penal Code. The accusation is that the informant Kanti Devi alongwith her family had gone to bath at the Ganga river on the occasion of Maghi Purnima. When she returned to her house, she came to know that her villagers, namely, Sita Ram Das, Sabujiya Devi, Kanchan Kumari, Archana Kumari and Sanjeev Das (petitioner) removed her house and the hand-pump and took away all the articles of the house. When she asked to Sitaram Das, he told that

She arranged the panchayati by the Mukhiya, Sarpanch and other villagers and the panchayati got Rs.50,000/- delivered to Suresh Das and asked the informant that he will execute the sale deed in respect of four dhur lands in her favour after the marriage of daughter of Sita Ram Das but in spite of performing the marriage of his daughter by Sita Ram Das, Suresh Das did not execute the sale deed in favour of the informant nor he returned the money to her and instead thereof, she was abused and assaulted. When Savita Kumari, the daughter of the informant, rushed to save the informant, the petitioner started to outrage her modesty.

Learned counsel appearing on behalf of the petitioner submits that, in fact, due to land dispute, some altercation took place in between the parties, due to that reason the informant lodged the present case with the false allegation against the petitioner to make attempt to outrage the modesty of her daughter. Further submission is that the petitioner has been made accused in this case as he is the son of the co-accused Sita Ram Das. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail

Patna High Court Cr.Misc. No.48082 of 2017 (2) dt.13-10-2017 3/3 on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Teghra P.S. Case No.145 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
