JUSTICE RAKESH KUMAR ORAL ORDER 09-05-2018 The sole petitioner, daughter of one of the F.I.R. named accused , apprehending her arrest in connection with Gaurichak P.S. Case No. 209 of 2017 registered for the offences under Sections 323, 324, 341, 448, 354, 354(B), 307, 379, 504, 506 and 34 of the Indian Penal Code, 1860, has prayed for grant of bail in the event of her arrest or surrender. From perusal of the record it appears that father of the petitioner had earlier filed a case vide Gaurichak P.S. Case No. 197 of 2017 on 10.8.2017 and thereafter, the present case was filed. Moreover, on perusal of the F.I.R. it appears that whatever accusation has been made against the petitioner appears to be only ornamental.
Considering the fact that petitioner is a lady as well as the nature of accusation, in the event of her arrest or surrender
Patna High Court Cr.Misc. No.27985 of 2018(2) dt.09-05-2018 2/2 within a period of eight weeks from today , let petitioner namely, Guriya Kumari be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anant Kumar, Judicial Magistrate 1st Class, Patna City/ concerned court in connection with Gaurichak P.S. Case No. 209 of 2017 subject to the conditions as contemplated under Section 438(2) of the Cr.P.C.
