JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 33, 41, 42, 52 of the Indian Forest Act and under section 4, 14 of Bihar Saw Mill Act, 1990.

The accusation is of running saw mill on 22.02.2001 when it was closed by the authorities in the year 1999 and consequently Govindganj P.S. case No. 119/1999 was registered. It is submitted by the learned counsel for the petitioner that petitioner is about 80 years of age and son of the petitioner, who was found present on the spot, has not been made accused and the petitioner has been roped in the present case.

Patna High Court Cr.Misc. No.2598 of 2016 (2) dt.18-01-2016 2/2 Since the case is instituted in the year 2001, this court is not inclined to enlarge the petitioner on anticipatory bail. Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Tr. No. 2953/15 arising out of Forest case No. 105/2001 pending in the court of learned S.D.J.M., Sadar, Motihari, East Champaran. Learned court below shall take into account the age of the petitioner while considering his prayer for regular bail.
