The petitioner seeks pre-arrest bail in connection with Mohania P. S. Case No.438 of 2017 registered under Sections 418, 419, 420/34 of the Indian Penal Code.
It is submitted that the case of the petitioner stands on similar footing to that of Chintu Singh, Saroj Gupta and Manoj Gupta, who have been granted pre-arrest bail vide order dated 17.10.2017 and 18.10.2017 passed in Cri. Misc. No.50074 of 2017 and Cri. Misc. No.48597 of 2017.

Patna High Court Cr.Misc. No.50764 of 2017 (2) dt.10-11-2017 2/2 produced by the learned counsel for the petitioner in course of the argument.
Learned Additional Public Prosecutor for the State has opposed the application for grant of pre-arrest bail to the petitioner. However, he admitted that the case of the petitioner stands identical to that of Chintu Singh, Saroj Gupta and Manoj Gupta.
Having regard to the submissions made above and for the reasons assigned in the aforesaid orders passed in Cri. Misc. No.50074 of 2017 and Cri. Misc. No.48597 of 2017, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in Mohania P. S. Case No.438 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
