The petitioner seeks bail in a case registered under Section 307 of the Indian Penal Code, 4/5 of Expl. Substances Act, Sections-150/152 Indian Railway Act and 17 of C.L.A. Act. The prosecution case in short is that under the leadership of the petitioner 20-25 armed Moist had planned to damage the Railway Property near Deo Halt. Electric wire was allegedly installed to blow the Railway track. The said wire was seized. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 13-05-2016. Charge sheet has already been submitted. Charge has not yet been

Patna High Court CR. MISC. No.25544 of 2019(4) dt.15-07-2019 2/2 framed. General and omnibus allegation has been made against the petitioner. No specific allegation of overt act has been attributed to the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj P.S. Case No. 50 of 2014.
