It appears from the office notes dated 04.08.2017 that this application, under Section 438 of the Code of Criminal Procedure, filed on behalf of the petitioner, is not maintainable in view of the order dated 07.07.2017 passed in Criminal Misc. No.26109 of 2017 by a Bench of this Court.

In that view of the matter, this application filed on behalf of the petitioner to grant him anticipatory bail in connection with Pasraha P.S. Case No.21 of 2017/G.R. No.488 of 2017, pending in the court of the Chief Judicial Magistrate, Khagaria, is dismissed as being not maintainable. However, the petitioner would be at liberty to seek remedy before the appropriate forum.
