The petitioner apprehends his arrest in Rautara P.S. Case No. 49/2015, registered for the offences punishable under Sections 325, 379 and other Sections of the Indian Penal Code. The informant, Md. Hajrat Ali named the petitioner along with five other accused persons and alleged that they were cutting Simal trees. When the informant asked not to cut trees, Md. Rafiq assaulted with sickle.

It appears that no specific allegation of assault is made against the petitioner. The occurrence took place on 24.10.2015 but the FIR was lodged on 27.10.2015. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court

Patna High Court Cr.Misc. No.46897 of 2016 (2) dt.13-12-2016 2/2 below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Rautara P.S.
