The petitioner apprehends his arrest in connection with Kashimbazar P.S. Case No. 138 of 2016 (G.R. Case No. 1916 of 2016), registered for the offences punishable under Sections 341, 323, 504, 506, 354(B), 379 and 34 of the Indian Penal Code. Allegedly, the petitioner being armed with lathi, Manish Kumar armed with pistol and Sobha Devi came and started abusing and further they started assaulting and when the informant protested then they claimed to kill Ravi Ranjan and when the husband of the informant came for rescue then they assaulted the husband of the informant and when the informant went to save her husband she was also made naked and further
Patna High Court Cr.Misc. No.53718 of 2016 (2) dt.20-12-2016 2/2 took away cash of Rs. 4400/- and gold chain and fled away. Submission is of false implication and that allegation under section 379 of the I.P.C. is super addition. This is a counter blast of case No. Kashimbazar P.S. Case No. 137 of 2016 which was lodged by Sobha Devi the wife of the petitioner and due to family dispute the occurrence has taken place and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.
In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Kashimbazar P.S. Case No. 138 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
