The petitioner seeks bail in Bheldi P.S. case No.99 of 2017 registered under Sections 147, 149, 188, 341, 323, 324, 307, 302, 504 of the Indian Penal Code, pending in the court of 4th Additional Sessions Judge, Saran at Chapra. The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is the assailant and the postmortem report supports the allegations made in the F.I.R. A report was called for from the trial court. It has been

Patna High Court CR. MISC. No.27808 of 2020(3) dt.28-01-2021 2/3 reported that out of twelve prosecution witnesses, nine prosecution witnesses have already been examined and some of the official witnesses are to be examined in the present case and the trial is expected to be concluded within a period of six months.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of six months from the date of receipt/production of a copy of this order. On the earlier occasion, a direction was made to the District Magistrate, Saran at Chapra and the Superintendent of Police, Saran at Chapra to ensure that the prosecution witnesses are produced in the court below on the date fixed by the court below so that the trial could be concluded within the stipulated period.

As per the report submitted by the trial court, only official witnesses are to be examined in this case.
