The petitioner seeks bail in connection with Kharik P.S. Case No. 227 of 2020 registered for the offence under Sections 386, 387, 506/34 of the Indian Penal Code. The prosecution story in short is that On 04.10.2020, Sintu Yadav @ Sintu Pahalvan, Gaurav Yadav, Chandan Yadav, Rahul Mandal and one unknown person came to the newly built house of the informant and they demanded extortion money of Rs. Five lakh to reside in the locality. Due to the demand of extortion, the informant left his house and started
Patna High Court CR. MISC. No.28244 of 2023(2) dt.24-05-2023 2/3 living at Tulsipur. The informant further alleged that the miscreants had broke open the lock of his house and on 03.11.2020, he received a phone call and the extortion money was again demanded from him.
Learned counsel for the petitioner submits that the petitioner is in custody since 18.08.2022 and he has committed no offence and he has been falsely implicated in this case. Learned A.P.P. has vehemently opposed the prayer for bail and he has submitted that the petitioner has 11 antecedents.
Considering the criminal antecedents of the petitioner and the allegation of demand of extortion, I am not inclined to grant bail to the petitioner.
This application stands rejected.
The District Judge- Bhagalpur is directed to transfer all the cases in which the petitioner is accused and the Court is directed to get the trial of all the cases registered against the petitioner expedited:-
