JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-09-2018 The learned counsel for the parties are in agreement that the present case can be disposed of in terms of the judgment dated 18.03.2015 passed in CWJC No. 23373 of 2011 except the interest and cost portion.

In view of the aforesaid, the order dated 17.05.2011 passed by the Principal Secretary, Water Resources Department, Government of Bihar, Patna is quashed and the respondents are directed to grant the benefits of ACP within a period of eight weeks from today in terms of the aforesaid judgment dated 18.03.2015.

It is needless to State that though the present order is being passed on the basis of the aforesaid judgment dated 18.03.2015, however in the present case no interest or cost shall be payable to the petitioner.
