Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners have preferred this application for grant of regular bail in connection with Arwal P.S. Case No. 354 of 2022 dated 25.7.2022 registered for the offences punishable u/s 379 of the Indian Penal Code.
As per the prosecution case, the allegation against the co-accused persons is of stealing the truck of the informant. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the
Patna High Court CR. MISC. No.28318 of 2023(2) dt.25-05-2023 2/2 petitioners. Nothing has been recovered from the conscious possession of the petitioners. The petitioner are not named in the FIR. The name of the petitioners has sprung up in the confessional statement of co-accused Sujit Kumar. The petitioners have 5 other criminal cases and in all the cases they are on bail as stated in para 3 of the bail petition. The petitioners are in custody since 13.12.2022.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bailbond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Arwal in connection with Arwal P.S. Case No. 354 of 2022.
The application stands allowed.
