JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 This is an application for grant of anticipatory bail in connection with Giriak (Katrisarai) P. S. Case No. 109 of 2019, disclosing offences under Sections 272 and 273 of IPC and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation of recovery of 55 liters of country made liquor from of the house of the petitioner.

Submission of the learned counsel for the petitioner is that the house is abandon house.

Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that recovery is from the house of the petitioner, which will appear from the seizure list, as such, this application is not maintainable.

Patna High Court CR. MISC. No.25565 of 2019(4) dt.04-09-2019 2/2 Having heard both sides, in view of the allegation and the quantity of the liquor recovered from the shop of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner.
