The petitioner apprehends his arrest in a case registered for the offence under Section 302, 504, 120(B) & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

F.I.R. has been lodged against 76 named and 20-30 unknown persons. The allegation against petitioner and other co-accused persons is that they demanded money and made firing, with the intention of creating panic, which hit on the chest of informant's husband, due to which, he died. It is submitted on behalf of petitioner that from bare perusal of the F.I.R., it is apparent that informant is not eyewitness of the occurrence. There is no specific allegation against this petitioner of causing fire-arm injury. The allegation is general and omnibus. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.28004 of 2022(2) dt.22-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur (Patna) in connection with Maner P.S. Case No. 752 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
