The petitioner seeks bail in a case registered under Sections-25(i-b)A, 26 of the Arms Act.

The allegation against the petitioner is that in course of patrolling, he was apprehended and a country-made pistol along with a cartridge was recovered from his possession. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 01-11-2018. Charge sheet has already been submitted. One country-made pistol with a cartridge is said to have been recovered. There is no compliance of Section 100 Cr.P.C.

On behalf of the State, it is submitted that the petitioner is

Patna High Court CR. MISC. No.25339 of 2019(3) dt.08-05-2019 2/2 named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 362 of 2018.
