2. Petitioner seeks regular bail in connection with Rajpur P.S. Case No. 318 of 2024, in a case registered for the offences punishable under Sections 103(1), 238, 61(2) and 3(5) of the BNS.
3. As per the prosecution story, FIR named accused persons in conspiracy with each other got killed the father of the informant with the help of other unknown killers.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Petitioner is not named in the FIR. Petitioner's name surfaced in this case during the course of investigation. Similarly situated co-accused person namely, Sunil Kumar Rai @ Sonu
Patna High Court CR. MISC. No.26472 of 2025(2) dt.27-06-2025 2/2 Rai has been granted regular bail by a co-ordinate Bench of this Court vide order dated 09.04.2025 passed in Cr. Misc. No. 2438 of 2025. Petitioner is in custody since 19.02.2023.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateI, Buxar, in connection with Rajpur P.S.
