This application for anticipatory bail arises out of Mahua P.S.Case N0. 160 of 2017, disclosing offences under Sections 341,323,379,504/34 of the Indian Penal Code. On perusal of the First Information Report, I notice that there is dispute between two families over some property. Case and counter case have been filed. Wife of Petitioner No.2 has lodged an FIR on the same date on 20.06.2017, registered as

Patna High Court Cr.Misc. No.42849 of 2017(2) dt.19-09-2017 2/3 Mahua P.S. Case No. 159 of 2017 for the offences punishable under Sections 341,323,324,447,385,307,354B,504/34 of the Indian Penal Code.

Considering the nature of dispute and the fact that the petitioners have no criminal antecedent, this application is allowed.

Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Mahua P.S. Case No. 160 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
