The petitioner apprehends her arrest in connection with Maheshkhut P.S. Case No. 111 of 2016, registered under Sections 420, 406 and 409 of the Indian Penal Code. The accusation is that petitioner being the In-charge Head Mistress of Primary School, Manrupa Nagar Kaua Kol, misappropriated Rs.5,36,015/- to the fund allocated for construction of the school building.
Learned counsel for the petitioner submits that, in fact, Rs.9,05,528/- was allocated for construction of the school building in the financial year 2011-12 of the Primary School, Manrupa Nagar Kaua Kol, in which, petitioner is Head Mistress and
Patna High Court Cr.Misc. No.48063 of 2017 (2) dt.12-10-2017 construction work of Rs.8,09,876/- was completed and remaining amount Rs. 95652/- with interest has been deposited by the petitioner, which would appear from the "No Dues Certificate" dated 08.08.2017 issued by the District Programme Officer, Khagaria.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Khagaria, in connection with Maheshkhut P.S. Case No. 111 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
