JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-02-2016 The petitioner seeks modification of order dated 14.10.2015 passed by this Court in Cr. Misc. No.43749 of 2015. It appears that the Sessions Judge while disposing of the bail application of the petitioner observed in its order dated 20.7.2015 that "the petitioner is taking benefit privilege of bail u/s 41A of the Cr.P.C., as it appears from paragraph 42 of the case diary, so there is no apprehension of his arrest". This Court too disposed of the aforesaid Criminal Misc. No.43749 of 2015 by order dated 14.10.2015 in the aforesaid terms.
The petitioner submits that now charge sheet has been submitted and there is a reasonable apprehension of his arrest. He submits that this application be disposed of in terms of the decision in the case of Mahendra Prasad Singh v. State of Bihar,
Patna High Court Cr.Misc. No.581 of 2016 (2) dt.10-02-2016 reported in 2004(3) PLJR 491.
As the petitioner Ramchandra Sahni has already allowed police bail, on his surrendering within four weeks from today, he would be enlarged on bail on furnishing fresh bail bonds to the satisfaction of the Court concerned, subject to the condition that he would not physically absent himself for two consecutive dates at a stretch till two witnesses are examined in trial, failing which his bail bond would be cancelled.
