JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dandari P.S. Case No. 41 of 2016 registered under Section-409 of the Indian Penal Code.

Petitioner was working as Panchayat Secretary at the relevant time and the accusation against him is that he did not produce the relevant documents on demand, made by the higher officials.

Submission on behalf of petitioner is that the petitioner produced the documents, which were in his possession and so far as some other documents are concerned; the same were not handed over to the petitioner, while he was taking charge. Moreover, having more or less similar allegation, some co-

Accordingly, this anticipatory bail is allowed and it is ordered that the petitioner named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dandari P.S. Case No. 41 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-III, Begusarai subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
