====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-01-2021 Heard Mr. Kunwar Narayan Jamuar, learned counsel for the petitioner and Mr. Akshay Lal Pandit, learned Additional Public Prosecutor appearing for the State.

Petitioner seeks regular bail in connection with Khizersarai P.S. Case No. 69 of 2020 registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

The allegation as per the First Information Report is that the petitioner along with other co-accused person namely, Raja Babu has kidnapped the daughter of the informant Puja Kumari for the purpose of marriage. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.27792 of 2020(4) dt.08-01-2021 2/3 petitioner has falsely been implicated in this case due to previous dispute with the family of the informant. Learned counsel further submits that there was a love affair between the co-accused Raja Babu and the victim girl. Learned counsel referring to Annexures 2 and 3 submits that the victim girl is major and she has solemnized marriage with the co-accused Raja Babu and both are leading their conjugal life. Learned counsel further submits that the petitioner is in custody since 7.3.2020 and the charge sheet has already been submitted and there is no apprehension that the petitioner will abscond or tamper with the evidence. Having regard to the submissions made by the parties and taking into consideration the materials on record, the fact that the petitioner is in custody since 7.3.2020 and charge sheet has already been submitted as well as there is no apprehension that the petitioner will abscond or tamper with the evidence, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like

Patna High Court CR. MISC. No.27792 of 2020(4) dt.08-01-2021 3/3 amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Gaya, in connection with Khizersarai P.S. Case No. 69 of 2020.

It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
