Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307/379/34 and other allied sections of the Indian Penal Code.

Petitioners are alleged to have assaulted the informant with lathi and then they took away his wrist watch and golden chain.

Learned counsel for the petitioners submits that there is a case and counter case in which the informant and others have also been made accused. There is general and omnibus

Patna High Court CR. MISC. No.26484 of 2019(3) dt.17-07-2019 2/2 allegation against them. Petitioner no.1 is a teacher in the Government school, whereas all the petitioners have got no criminal antecedent.

Considering the facts of the case, let all the five petitioners, above named, in the event of their arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Bhojpur at Ara in Charpokhari Police Station Case No. 28 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioners.
