2. The petitioner is in custody in connection with S.T. No. 402/2024 arising out of Lachhuar P.S Case No. 97 of 2023 registered for the offences punishable under Sections 341, 323, 379, 307, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.

3. Earlier the bail application of the petitioner was rejected vide Cr. Misc. No. 35374 of 2024, He further submits that petitioner is in custody since 27.10.2023. On previous occasion, progress of trial has been called for. From progress report, it appears that charges has been framed against the petitioner on 20.09.2024 (due to typographical error it has been

He further submits that there is no eyewitness to this case. He further submits that one of the coaccused has ben granted bail vide Cr. Misc. No. 39502 of 2024.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order dated 25.04.2024, and the stage of the trial and other materials available on record, period of custody and also considering the facts that one of the co-accused has been granted bail vide Cr. Misc. No. 39502 of 2024 and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-V in connection with with S.T. No. 402/2024 arising out of Lachhuar P.S Case No. 97 of 2023 (Ramesh Chand Malviya, J) Sunnykr/- U
