JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 11-08-2015 There were reasons for the authorities to doubt the authenticity of the certificate issued by the Weightlifters Association because two persons cannot be declared to have come first in their category simultaneously in the same year. Obviously, such certificates are available for consideration and not much weightage can be given to such certificates in matters of public appointment. Counsel for the petitioner submits that a clarification was sought from the Association and the Association did certify that both had become first. It has to be a case of tie for two persons to be declared first in a competition in the category of 62 kilos, a phenomenon rarely heard, if not experienced.

Patna High Court CWJC No.10271 of 2008 dt.11-08-2015 2/2 Appointment relates to the advertisement of the year 2004. The controversy is allowed to rest. No direction is required to be issued in favour of the petitioner under such controversial circumstances. Writ is dismissed.
