The petitioners seek bail in connection with Lakhisarai P. S. Case No. 14 of 2018 instituted for the offence under Section(s) 302/34/120B of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for petitioners has submitted that both these petitioners were earlier accused in Kajra P.S. Case No. 50 of 2017 and petitioner no. 1 is in custody since 03.08.2017 and petitioner no. 2 is in custody since 05.05.2017 in this case. The alleged occurrence has taken place on 09.01.2018.

Learned counsel for petitioners submits that informant

Patna High Court CR. MISC. No.25483 of 2019(2) dt.24-04-2019 2/2 is not an eye-witness to the occurrence. Informant has merely raised suspicion against these petitioners that due to previous enmity they might have committed murder of her husband. In the written report, it is alleged that informant learnt from her Bhaisur, namely, Ashok Singh, the name of five persons and three unknown persons as assailants as mentioned in the written report. The Bhaisur of the informant did not disclose the name of these petitioners to the informant. She has merely raised suspicion against these petitioners that due to previous enmity they have committed the murder of her husband .

Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 14 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) shyambihari/mu keshU T
