JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is a P.D.S. dealer, bearing license no. 36 of 1992. He seeks quashing of the order dated 23.07.2014, passed by the Sub-Divisional Officer, Tekari cancelling his license.

The petitioner has brought to the notice of this Court, the various discrepancies in the order of the licensing authority. The petitioner submits that he has produced all the registers, but the respondents without considering the same has passed the impugned order.

In my view, the petitioner can raise all these points in

Patna High Court CWJC No.19775 of 2014 (2) dt.21-09-2015 2 / 2 appeal before the appellate authority. In case, the petitioner files an appeal before the appellate authority, the delay in filing the appeal would be condoned, as the petitioner was pursuing his remedy before this Court. It is expected that the appeal filed by the petitioner would be disposed of preferably within a period of four months.

This application stands disposed of.
