The petitioner apprehends his arrest in connection with Forbesganj P.S. Case No. 115 of 2011 registered for the offences punishable under Section 364/34 and other Sections of the Indian Penal Code.

Learned counsel for the petitioner submits that the present prosecution case has been lodged after delay of 40 days for which no plausible explanation has been offered by him. It is further submitted that the petitioner has been implicated in this case on mere suspicion.

Considering the entire gamut of circumstances and the material which has surfaced in the case diary which shows that the case is based on purely suspicion, conjecture and surmises and also on account of the fact

No.58584 of 2015 (3) dt.22-04-2016 that the petitioner has got no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is/are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate (P.F.), Araria in connection with Forbesganj P.S. Case No. 115 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J) Jagdish/- U T
