2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 352, 351(2), 74, 79 and 3(5) of B.N.S.
3. The case of the prosecution, in short is that the petitioner has assaulted with iron rod on the head of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned cousnel for the petitioner has submitted that from perusal of the injury report, it will transpire that the nature of injury is simple and caused by hard and blunt substance. It has further been submitted that from
Patna High Court CR. MISC. No.28915 of 2026(2) dt.05-05-2026 2/2 perusal of the F.I.R., it is clear that the date of occurrence is 29.09.2025 whereas the F.I.R. has been lodged on 05.10.2025. There is delay of six days and the delay is not explained. Petitioner is languishing in judicial custody since 31.01.2026.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and has submitted that petitioner is having criminal antecedent of two cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dhoraiya P.S. Case No. 270 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Banka.
