The petitioner apprehends his arrest in Imamganj P.S. Case No. 100/2015, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. The mother of deceased alleged that on 30.07.2015 Shambhu Singh (petitioner) took her son Ramjee Singh on the pretext of some work, but her son did not return. She further named Chitranjan Singh, Navin Singh, Praveen Singh, Ashok Singh, Pankaj Singh and Chandrika Bhuiya and alleged that they were threatening to her son of dire consequence. Learned counsel for the petitioner submits that the petitioner is friend of the deceased who used to visit the house of the deceased off and on. Petitioner has got no enmity. Patna High Court Cr.Misc. No.46171 of 2016 (3) dt.21-12-2016 2/2 killed son of the informant have already been granted anticipatory bail. Independent witnesses have also stated that the petitioner is of good character and he used to visit the house of the deceased, but it appears that the informant alleged that it was the petitioner who took her son Ramjee Singh with him. Ramjee Singh did not return, thereafter, the dead-body of her son was recovered. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
