The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147/148/149/341/323/332/353/354B of the Indian Penal Code. The petitioner is an advocate and allegation is that near the Court-room he attempted to outrage the modesty of the informant, who was the constable deputed there. Submission of the petitioner is that the petitioner has got no criminal antecedent and the false allegation is there due to some dispute regarding allowing the entry of the client of the petitioner in the Court room.
Patna High Court Cr.Misc. No.49413 of 2016 (3) dt.03-02-2017 2/2 Learned Additional Public Prosecutor submits that other constables have supported the allegation of the informant. Considering the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court in connection with Araria Police Station Case No.572 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
