Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
The prosecution case is that the accused persons were breaking the glass of the truck and took out Rs.10,000/- from a bag and escaped from the scene. However, the cleaner of the truck was apprehended by the local people, who suggested the name of the petitioner and others, who have taken away the money.
It is submitted by the learned counsel for the petitioner that only on confession of co-accused, petitioner has been roped in the present case. Though the petitioner is accused in two other cases of similar nature.
Patna High Court Cr.Misc. No.3280 of 2016 (2) dt.30-01-2016 Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Gardanibagh P.S. Case No. 300 of 2015, pending in the court of learned Sri Manoj Kumar, Vth, J.M., Ist Class, Patna.
With the above observation this application is disposed of.
